Welcome to Datameris LaunchPad. These Terms & Conditions (“Terms”) constitute a legally binding agreement between Datameris LaunchPad (“Company,” “we,” “us,” or “our”) and any individual who accesses the Datameris LaunchPad website, creates an account, enrols in or purchases a course, attends a live or offline session, or otherwise uses any service offered by the Company (each, a “User” or “student,” as applicable).

By accessing the website at Datamerislaunchpad.com, registering an account, submitting an enquiry, enrolling in a course, making a payment, or otherwise using our services in any manner, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Refund Policy, each of which is incorporated into these Terms by reference and available at privacy policy and refund cancellation policy respectively.

If you do not agree with any part of these Terms, you must discontinue use of the website and services immediately. If you are accessing or using the services on behalf of a company, organisation, or another individual, you represent that you have the authority to bind that entity or person to these Terms.

These Terms apply to all current and future courses, programs, workshops, mentorship sessions, and services offered by Datameris LaunchPad, whether delivered online, offline, or in a blended format, including the AI-Integrated Digital Marketing Program and any subsequent skill-development or career-oriented courses that may be introduced from time to time.

Intellectual Property Rights

All content made available by the Company as part of the services — including but not limited to recorded and live session videos, lecture notes, PDFs, presentations, assignments, project briefs, templates, frameworks, case studies, quizzes, and assessment materials, as well as the website’s design, layout, text, and graphics, the Datameris LaunchPad name, logo, and brand assets, and all other learning materials — is and shall remain the exclusive intellectual property of the Company or its licensors. These materials are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws of India.

Enrolment in a course grants students a limited, non-exclusive, non-transferable, revocable licence to access and use the learning materials solely for personal, non-commercial, educational purposes during (and, where applicable, after) the course, subject to these Terms. No ownership rights are transferred to the student under any circumstances.

Without the prior written permission of the Company, students shall not:

  • Copy, reproduce, or duplicate any learning material, in whole or in part.
  • Record, screenshot, or capture live or recorded sessions using any device or software.
  • Share, distribute, upload, or transmit learning materials to any third party or public platform.
  • Sell, rent, lease, sublicense, or otherwise commercially exploit any learning material.
  • Publish or post learning materials on any website, social media platform, file-sharing service, or online forum.
  • Modify, adapt, translate, or create derivative works based on the learning materials.
  • Remove, obscure, or alter any copyright, trademark, or proprietary notice contained in the learning materials.

Any unauthorised use of the Company’s intellectual property shall constitute a material breach of these Terms and may result in the immediate suspension or termination of access, in addition to civil and criminal remedies available to the Company under applicable law, including claims for damages and injunctive relief.

Eligibility

  • You must be at least 16 years old to enrol.
  • If you are between 16 and 18 years of age, you may only enrol if a parent or legal guardian (a) provides express written consent to your enrolment, and (b) agrees, as the contracting party, to be bound by these Terms on your behalf, since a minor does not have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872. The parent or legal guardian shall be responsible for all obligations under these Terms, including payment of fees, arising from the minor’s enrolment.
  • If you are 18 years of age or older, you must have the legal capacity to enter into a binding contract under Indian law in your own right.
  • When registering, you (or, for a minor, your parent/guardian) must provide accurate and complete information and keep it up to date.
  • The Company reserves the right to refuse or cancel enrolment if these conditions are not met.

Student Registration

  • It is your responsibility to maintain the security and confidentiality of your login credentials.
  • You are responsible for all activities carried out under your account.
  • The Company reserves the right to verify the information submitted and may suspend accounts that include false or misleading details.
  • Accounts are strictly personal and may not be shared or transferred. 

Course Enrolment

  • Enrolment is confirmed only after registration, acceptance of these Terms, and payment of the applicable fees.
  • Admission is at the sole discretion of the Company and may involve a screening or counselling call.
  • Batch schedules and course availability are subject to change.
  • The Company may modify the course curriculum, mentors, or delivery format and may add or discontinue courses at its discretion.

Payments

  • Course fees shall be as displayed on the website or as communicated during enrolment.
  • Payments may be made via net banking, debit or credit cards, UPI, or approved EMI/financing partners.
  • Applicable taxes (including GST) shall apply in addition to the course fee unless otherwise stated.
  • Non-payment of fees may result in suspension of access until all outstanding dues are cleared.
  • Invoices or receipts will be issued for all payments received.

Student Responsibilities

As a student of Datameris LaunchPad, you are expected to conduct yourself in a manner consistent with a professional learning environment, including the following:

  • Maintaining professional and respectful behaviour towards mentors, Company staff, and fellow students at all times, whether in online, offline, or written communication.
  • Communicating in a courteous and constructive manner during live sessions, discussion forums, and one-on-one mentorship interactions.
  • Maintaining regular attendance and punctuality for scheduled live sessions, mentorship calls, and offline classes to the extent reasonably possible.
  • Completing and submitting assignments, projects, and assessments within the timelines communicated by the Company or the concerned mentor.
  • Undertaking assessments, quizzes, and projects honestly and independently, without engaging in plagiarism or unauthorised assistance, except where explicitly permitted as part of collaborative learning.
  • Maintaining confidentiality regarding any proprietary tools, internal processes, or non-public information shared by the Company, its mentors, or its placement or industry partners during the course of the program.
  • Refraining from cheating or engaging in dishonest conduct during assessments.

Assessments & Certification

As a student of Datameris LaunchPad, you are expected to conduct yourself in a manner consistent with a professional learning environment, including the following:

  • Maintaining professional and respectful behaviour towards mentors, Company staff, and fellow students at all times, whether in online, offline, or written communication.

Disclaimer of Warranties

The services, learning materials, and website are provided on an “as is” and “as available” basis. While the Company takes reasonable steps to ensure the accuracy and quality of course content, it does not warrant that the services will be uninterrupted, error-free, or fit for any particular purpose, or that enrolment or completion of any course will result in any specific career, employment, or income outcome.

Limitation of Liability

To the maximum extent permitted under applicable law, the Company, its directors, employees, mentors, and affiliates shall not be liable for any indirect, incidental, special, or consequential loss or damage — including loss of income, opportunity, or data — arising out of or in connection with your use of the services. Nothing in these Terms shall be construed to limit the Company’s liability where such limitation is not permitted by law.

Indemnification

You agree to indemnify and hold harmless the Company, its directors, employees, mentors, and affiliates from and against any claims, losses, liabilities, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms, misuse of the services, or violation of the Company’s intellectual property rights or applicable law.

Amendments to These Terms

The Company reserves the right to modify or update these Terms at any time. Material changes will be notified to registered students via email or through a notice on the website, and the “Last Updated” date at the top of this page will be revised accordingly. Continued use of the services after such changes constitutes acceptance of the revised Terms.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, the courts at Kochi, Kerala shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

General Provisions

  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and the Company with respect to the services, superseding any prior agreements or understandings.
  • No Waiver: The Company’s failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
  • Notices: Any notice required to be given under these Terms shall be sent to the contact details provided during registration, or, for notices to the Company, to the contact information in Section 17.
